Terms of Service

These Terms of Service ("Terms") govern your access to and use of CargoReach, operated by XPERT GROUP PTE LTD, 60 Benoi Rd, #02-15, Singapore 629906 (UEN: 201423705Z) ("CargoReach", "we", "us"). By creating an account or using the service, you agree to these Terms.

1. The Service

CargoReach is a newsletter and marketing platform built for freight forwarders. It helps you generate, translate, validate, schedule, and send email newsletters to your own contacts, and — where you choose to connect them — publish related content to your LinkedIn and/or Facebook Page.

2. Accounts

You must provide accurate information when creating an account and keep your login credentials confidential. You are responsible for all activity that occurs under your account, including actions taken by team members you invite.

3. Subscription plans and billing

CargoReach offers a free Starter plan and paid plans (Growth and Multi-branch). Paid subscriptions are billed through Stripe, on a recurring basis (monthly or annual, as selected), and renew automatically until cancelled. You can manage or cancel your subscription at any time through the billing portal available in your account settings. Fees are non-refundable except where required by law.

4. Your contacts and acceptable use

You are solely responsible for the newsletter contacts you import or collect (including through our embeddable widget), and for ensuring you have a valid legal basis — such as consent or an existing business relationship — to send them marketing communications under the laws that apply to them. You agree not to:

Import or send to purchased, rented, or scraped contact lists without a legitimate basis to contact them.
Use the service to send unsolicited bulk email (spam), or content that is unlawful, fraudulent, defamatory, or infringing.
Attempt to circumvent sending limits, warm-up safeguards, or security controls built into the service.

We may suspend or terminate accounts that we reasonably believe violate this section, to protect the deliverability and reputation of the platform for all customers.

5. Publishing to LinkedIn and Facebook

If you choose to connect a LinkedIn account or Facebook Page, you authorize CargoReach to publish content you have reviewed and approved on your behalf. You remain responsible for the content published under your name or Page, and for complying with LinkedIn's and Meta's own platform policies.

6. Intellectual property

You retain ownership of your content, contact data, and brand assets. We retain ownership of the CargoReach software, templates, and underlying technology. You grant us a limited license to process your content and data solely to provide the service to you.

7. Service availability

We aim to keep CargoReach available and reliable, but we do not guarantee uninterrupted or error-free operation. Scheduled maintenance, third-party outages (including our email-sending or hosting providers), or events outside our reasonable control may affect availability.

8. Limitation of liability

To the maximum extent permitted by law, CargoReach and XPERT GROUP PTE LTD shall not be liable for any indirect, incidental, or consequential damages, including loss of revenue or business opportunities, arising from your use of the service. Our total liability for any claim relating to the service is limited to the amount you paid us in the twelve months preceding the claim.

9. Termination

You may stop using the service and delete your account at any time. We may suspend or terminate your account for breach of these Terms, non-payment, or conduct that risks the security or deliverability of the platform, with notice where reasonably possible.

10. Changes to these Terms

We may update these Terms as the service evolves. Material changes will be communicated to active account holders. Continued use of CargoReach after changes take effect constitutes acceptance of the updated Terms.

11. Governing law

These Terms are governed by the laws of Singapore, without regard to conflict-of-law principles, unless mandatory consumer or data protection law in your jurisdiction requires otherwise.
